The EU Machinery Directive (2006/42/EC) is being replaced by the EU Machinery Regulation (EU 2023/1230), which becomes mandatory from 20 January 2027. Manufacturers must track existing certification status while planning transition โ and existing certificates don't automatically become compliant.
EC-type examination certificates issued under the Machinery Directive have fixed validity periods. A lapsed certificate before the 2027 transition deadline means your machinery cannot be placed on the EU market.

CE marking under the Machinery Directive requires a Declaration of Conformity, a technical file and โ for high-risk machinery categories โ an EC-type examination certificate from a Notified Body. Each has documentation that must remain current. And from 2027, the underlying regulation changes entirely.
The DoC must reference current applicable directives and harmonised standards. When standards are updated, the DoC must be reviewed and reissued to maintain compliance.
For Annex IV machinery, EC-type examination certificates from Notified Bodies have a fixed validity โ typically 5 years. Missing renewal means the certificate lapses and machinery cannot be placed on market.
The EU Machinery Regulation replaces the Directive from January 2027. Machinery placed on the EU market after that date must comply with the new regulation โ existing Directive certificates cannot simply be carried forward indefinitely.
Any significant modification to machinery may require reassessment of CE marking. Without a tracking system, modifications and their compliance implications are easily overlooked.
Post-Brexit, machinery sold in Great Britain requires UKCA marking rather than CE. UK manufacturers exporting to the EU must maintain both โ tracked and managed separately.
The technical file underpinning CE marking must be maintained and updated throughout the product's lifetime. Outdated technical files create compliance exposure even when the certificate appears valid.
Machinery placed on the EU market without valid CE marking is illegal. Distributors and importers must withdraw non-compliant products โ creating supply chain disruption and return costs.
EU market surveillance authorities actively check machinery CE marking. Non-compliant machinery can be ordered off the market with fines and mandatory recall โ regardless of how long it has been in circulation.
Machinery placed on the market without valid conformity documentation creates product liability exposure for the manufacturer. In the event of an incident, the validity of the CE marking at the time of supply is directly relevant.
