โš ๏ธ  The EU Machinery Regulation (2023/1230) is replacing the Machinery Directive. Machinery placed on the market from 2027 must comply with the new regulation. Transition planning requires tracking existing certificates now.

โš™๏ธ Machinery Directive & EU Machinery Regulation

Machinery compliance
certificates expire.
And the regulation
is changing.

The EU Machinery Directive (2006/42/EC) is being replaced by the EU Machinery Regulation (EU 2023/1230), which becomes mandatory from 20 January 2027. Manufacturers must track existing certification status while planning transition โ€” and existing certificates don't automatically become compliant.

EC-type examination certificates issued under the Machinery Directive have fixed validity periods. A lapsed certificate before the 2027 transition deadline means your machinery cannot be placed on the EU market.

What machinery compliance requires

Machinery CE marking is not
a one-time exercise.

CE marking under the Machinery Directive requires a Declaration of Conformity, a technical file and โ€” for high-risk machinery categories โ€” an EC-type examination certificate from a Notified Body. Each has documentation that must remain current. And from 2027, the underlying regulation changes entirely.

๐Ÿ“‹

Declaration of Conformity must stay current

The DoC must reference current applicable directives and harmonised standards. When standards are updated, the DoC must be reviewed and reissued to maintain compliance.

๐Ÿ”ฌ

EC-type examination certificates expire

For Annex IV machinery, EC-type examination certificates from Notified Bodies have a fixed validity โ€” typically 5 years. Missing renewal means the certificate lapses and machinery cannot be placed on market.

๐Ÿ”„

2027 regulation transition

The EU Machinery Regulation replaces the Directive from January 2027. Machinery placed on the EU market after that date must comply with the new regulation โ€” existing Directive certificates cannot simply be carried forward indefinitely.

๐Ÿญ

Product modifications require reassessment

Any significant modification to machinery may require reassessment of CE marking. Without a tracking system, modifications and their compliance implications are easily overlooked.

โš™๏ธ

UKCA for UK market

Post-Brexit, machinery sold in Great Britain requires UKCA marking rather than CE. UK manufacturers exporting to the EU must maintain both โ€” tracked and managed separately.

๐Ÿ“„

Technical file maintenance

The technical file underpinning CE marking must be maintained and updated throughout the product's lifetime. Outdated technical files create compliance exposure even when the certificate appears valid.

When machinery certificates lapse

Machinery without valid CE marking
cannot be placed on the EU market.

๐Ÿšซ

Market access blocked

Machinery placed on the EU market without valid CE marking is illegal. Distributors and importers must withdraw non-compliant products โ€” creating supply chain disruption and return costs.

๐Ÿ“‹

Market surveillance enforcement

EU market surveillance authorities actively check machinery CE marking. Non-compliant machinery can be ordered off the market with fines and mandatory recall โ€” regardless of how long it has been in circulation.

โš–๏ธ

Product liability exposure

Machinery placed on the market without valid conformity documentation creates product liability exposure for the manufacturer. In the event of an incident, the validity of the CE marking at the time of supply is directly relevant.

FAQ

Common questions.

What is the difference between the Machinery Directive and the Machinery Regulation? +
The Machinery Directive (2006/42/EC) is the current EU framework for machinery safety. The EU Machinery Regulation (2023/1230) replaces it and becomes mandatory from 20 January 2027. The new regulation introduces new requirements for software-driven machinery and AI-integrated systems. Manufacturers must plan their transition now.
Do existing Machinery Directive certificates remain valid after 2027? +
EC-type examination certificates issued under the Directive remain valid until their expiry date โ€” but machinery placed on the EU market from 20 January 2027 must comply with the new Regulation. This means manufacturers need to transition their conformity assessments before that date.
Can CertNesher track the 2027 transition deadline? +
Yes. You can add the 2027 transition deadline as a tracked record with alerts at key intervals โ€” giving your engineering and compliance teams advance notice to plan reassessment and re-certification under the new Regulation.
Can CertNesher track both Machinery Directive CE marking and UKCA for the UK market? +
Yes. CertNesher tracks CE and UKCA independently โ€” different expiry dates, different responsible persons, different alert schedules. Post-Brexit, UK manufacturers exporting to the EU need both tracked separately.
